WAIVER OF LIABILITY, RELEASE, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT: For in consideration of PARTICIPANT'S registration with East End Hockey and Senior Hockey leagues, zones, local associations or members, and East End Ice, Inc (hereafter EEHA/EESHA/EEI), and being allowed to participate in sanctioned events and activities, the parent(s) or legal guardian(s) of PARTICIPANT and the undersigned members relinquish any and all liability for and cause of action for personal injury, property damage or wrongful death occurring to PARTICIPANT arising out of participation in EEHA/EESHA/EEI sanctioned events or activities, or the sport of inline or roller hockey, and/or activities incidental to these where ever or however they may occur. The terms of this waiver, release, assumption of risk and indemnity agreement shall apply for such a period said activities may continue, and by this agreement any such claims, rights and causes of action that PARTICIPANT may have are hereby relinquished and the PARTICIPANT (or parent(s)/guardian(s)) does(do) son on behalf of my/our and PARTICIPANTS heirs, executors, administrators and assigns. PARTICIPANT (or parent(s)/guardian(s)) acknowledge, understand and assume all risks inherent with hockey and any member team activities, and understand that said sport and activities involve risks to PARTICIPANT'S person including bodily injury, partial or total disability, permanent paralysis, and death and damages which may result, and that I/We have full knowledge of said risks. These risks and dangers may be caused by the negligence of the PARTICIPANT or the negligence of others including the "RELEASEES" identified below. It is further acknowledged that there may be risks and dangers not known to EEHA/EESHA/EEI, to us, or are not reasonably foreseeable at this time. PARTICIPANT (or parent(s)/guardian(s)) acknowledge, understand and assume the risks if any, arising from the conditions and use of the hockey arena and related premises and acknowledges and understands that included within the scope of this waiver and release is any cause of action, arising from the performance or failure to perform maintenance, inspection, supervision or control of said areas and for the failure to warn of dangerous conditions existing at said rinks, for negligent selection of certain RELEASEES, or negligent supervision or instruction by RELEASEES. IT IS THE PURPOSE OF THIS AGREEMENT TO EXEMPT, WAIVE AND RELIEVE THE BELOW LISTED RELEASEES FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, AND WRONGFUL DEATH CAUSED BY NEGLIGENCE, INCLUDING THE NEGLIGENCE, IF ANY, OF RELEASEES. 'RELEASEES' include East End Hockey Association, East End Senior Hockey Association, East End Ice, Inc and the Town of East Hampton, member teams, event hosts, other participants, coaches, referees/officials, sponsors, advertisers, owners and operators of the premises used to conduct any event and each of them, their officers, directors, agents and employees. PARTICIPANT (or parent(s)/guardian(s)) agree if any claim for PARTICIPANT'S personal injury or wrongful death is commenced against RELEASEES, he/she shall defend, indemnify and save harmless RELEASEES from any and all claims or causes of action by whomever or wherever made or presented for PARTICPANT'S personal injuries, property damage or wrongful death. If the law in any controlling jurisdiction renders any part of this agreement unenforcable, the remainder of this agreement shall nevertheless remain enforceable to the full extend, if any, allowed by controlling law. This agreement affects your legal rights, and you may wish to consult an attorney concerning this agreement. Upon entering events sponsored/sanctioned byEEHA/EESHA/EEI and/or its sanctioned leagues. I/We agree to abide by the rules ff EEHA/EESHA/EEI as currently in force. I/We understand and appreciate that participation or observation of the sport constitutes a risk to me/us of serious injury, including permanent paralysis or death. I/We voluntarily and knowingly recognize, accept, and assume this risk and release East End Hockey Association, East End Senior Hockey Association, East End Ice, Inc and the Town of East Hampton, member teams, event hosts, other participants, coaches, referees/officials, sponsors, advertisers, owners and operators of the premises used to conduct any event and each of them, their officers, directors, agents and employees from any liability therefore. PARTICIPANT AND/OR PARTICIPANT'S PARENT(S)/GUARDIAN(S) ACKNOWLEDGE THEY HAVE READ THE ABOVE PARAGRAPHS AND HAVE NOT RELIED UPON ANY REPRESENTATIONS OF RELEASEES, THAT THEY ARE FULLY AWARE OF AND ADVISED OF THE POTENTIAL DANGERS OF HOCKEY(ROLLER/INLINE), AND SIGN THIS DOCUMENT VOLUNTARILY, UNDERSTANDING THAT IT IS NECESSARY TO ALLOW AMATEUR HOCKEY (ROLLER/INLINE) TO EXIST IN ITS PRESENT FORM
